A Minnesota Preteen May Be Charged With DUI | Fairfax DUI Attorney

All states have additional DUI or DWI penalties if the driver is under the age of 21, and some have further sanctions for those under 18. But what if the offender isn’t even old enough to drive legally, much less drink alcohol?

Minnesota may want to consider putting something on the books. According to Winona County authorities, a 12-year-old girl may receive a DWI after she ran a car off a rural road.

Responding officers suspected the girl was drinking, but they were in for a surprise when they asked for her license—only to find she didn’t have one. Because she is 12.

It gets weirder. The girl’s passenger, Benjamin Repinski, is 19 and a licensed driver.

Repinski told authorities that he met the girl at a party and asked her to drive him home. At some point, she mixed up the gas pedal and brake, causing her to hit a highway sign and plow through a yard. At that point, Repinski got behind the wheel, and struck a shed.

He has been cited with underage drinking and driving, underage drinking, and allowing an unlicensed person to drive (all misdemeanors). The girl (whose name is not being released) was released to her mother after blowing a .09

Don’t worry, it still gets weirder. As a deputy left the scene to interview the girl at the hospital, he saw a man wobbling along on a moped, wearing sunglasses despite the fact that it was a little after midnight.

Daniel Arndt, the moped driver, was cited with DWI. Arndt stated he was on his way to pick up Repinski, who had called him after the crash, asking for a ride.
