News van dashcam video used to secure DWI conviction | Stafford DWI Lawyer
You never know when a camera may be watching and recording your activity and be held against you in court. This is what exactly happened to 57-year-old Chol Ki Lee when Kurt Brooks a reporter/photographer for 9News spotted him weaving, speeding and randomly braking on I-95 south on March evening. Kurt Brooks was heading home from work in a 9News Live van and turned on his dashcam to record Lee’s erratic driving.
It was clear this was not just somebody weaving down the road. He almost killed somebody. Actually I felt like I failed, because I’d been working so hard to try and get this guy pulled over and here we are, after all this time, and he’s gonna go ahead and kill somebody right in front of me. And I was really regretting watching what I was watching – Kurt Brooks.
Brooks called 9-1-1 to notify them of a possible drunk driver and continued to follow Lee for approximately 25 miles from Prince William County to Stafford County recording the events unfold on his dashcam. At one point, Brooks was cut off by Lee and later he witnessed Lee move over into the path of oncoming traffic. Luckily the other driver swerved out of the way just in time to avoid a head-on collision.
Police finally caught up to Lee and arrested him for driving while intoxicated registering a blood alcohol content (BAC) of 0.14 which is nearly twice the legal limit.
Brook’s capture of Lee’s near head-on collision and obvious drunk driving proved valuable as his video was shown in court on Tuesday in Stafford County and secured a DWI conviction for Chol Ki Lee. The Commonwealth’s Attorney was thankful for this evidence that compelled the judge to sentence Lee to 60-days in jail with all but five days suspended, a $300 fine and a suspended driver’s license for a year, with the exception of driving for work since Lee earns a living as a delivery driver.
