Warren County Commonwealth’s Attorney Office Reduces Pro-Wrestler Kurt Angle’s DUI Charge to Reckless Driving
The Warren County Commonwealth’s Attorney Office has reduced professional wrestler Kurt Angle’s September 4th charge for driving under the influence to a count of reckless driving. Angle was pulled over by a Virginia state trooper last month after the officer noticed that Angle’s vehicle was swerving and repeatedly crossing the centerline. The arresting officer, C.R. Scally, reported that Angle smelled strongly of alcohol which prompted the initiation of several field-sobriety tests. After Angle struggled to complete tests that included the recitation of the alphabet, Scally administered a breath test to Angle, with the outcome indicating that the wrestler had been driving with a blood-alcohol level of 0.091 percent. A second blood-alcohol test was given to Angle two hours after his arrest and yielded a result of 0.06, placing Angle below the legal limit of 0.08.
In the days that followed the wrestler’s arrest, Angle’s lawyer, C. Todd Gilbert, stated that the results obtained from the first roadside test would be inadmissible in court due to the high potential for inaccuracy and the protocol that had been used. Angle has steadfastly maintained that he was not intoxicated at the time of his arrest.
Because reckless driving and a first offense for driving under the influence carry the same penalties in Virginia, Angle may still face a maximum sentence of one year in jail and a $2,500 fine if he is convicted. This is not the first time Angle has found himself in trouble with the law for drinking and driving, however; Angle was cleared of charges following a 2007 arrest in Pennsylvania for allegedly driving under the influence and was sentenced to a year of probation by a North Dakota judge after Angle was accused of crashing his car while drunk in April.
